HIGH PROFILE SERIOUS FRAUD

R v Vidgeon and Patel [Ongoing from 12th Apr 2010~22nd July 2010]
An SFO prosecution of a complicated Boiler Room fraud that ran from 2003 to 2006. These two defendants were sentenced at Ipswich Crown Court on the 22nd of July to 7 years each following trial. They were running an illegal high pressure, share-pushing operation from call centres in Spain. Around 1,250 investors in the UK were persuaded to buy over £7 million worth of shares.

R v Nevitt Greene and Boardman
2008 SFO prosecution.
A complicated and extensive factoring fraud.
The defendants were an accountant and two directors of a large computer concern.
This was the second of two linked trials.
The first concerned a fraud on a government training scheme and was tried in 2006.
A third similar trial was dealt with in late 2008.
An appeal against conviction was heard in September 2009. The issue on appeal was the adequacy of the directions in relation to a hostile witness. The appeal was successfully resisted. REPORTED [2009] WLR[D] 285

R v Cadwell Pope and Curley
An SFO prosecution of a high yield investment fraud committed using the cover of English Accountants and Solicitors to defraud foreign investors.

MURDER / MANSLAUGHTER /SERIOUS VIOLENCE

R v James Watt and others Feb- Apr 2010
The `Blue Lagoon Murder’. This case concerned the torture killing and dismemberment of a vulnerable adult. It involved the successful use of the provisions of Section 5 DVCVA to the setting of an unrelated adult within family situation.

R v Marshall and Bush Jan-Feb 2010-05-09
The `Jigsaw Murder’. Body parts of the victim were discovered in various locations in Hertfordshire and Leicestershire in 2009. Marshall was a man experienced in disposing of victims. The case concerned the analysis of the methods of dismemberment used and the picture of the movements of the defendants using a combination of cell site and ANPR records.

R v Wood and Wood 2009
Involving a shaken baby whose brain ceased to grow and whose life expectancy was substantially reduced. Central were issues of causation in the context of shaken baby syndrome and analysis of other injuries.

R v Miran Thakrar and others 2008
The killing of three men in a planned execution set in the context of drug dealing. Two women were stabbed in the same incident. A six handed case, two murderers and four assisters. The second defendant fled to Northern Cyprus. Evidence of informal confessions from Cyprus was used employing s.116 and 121 of the CJA 2003. Both main defendants were convicted of three murders and two attempted murders. Miran Thakrar’s schedule 21 period, in relation to his life sentence, was set at 42 years, for his brother, 35 years.

R v Walsh Bruce Conteh and Agbugba-Cansie. 2008 / 2009 / 2010
Murder / Conspiracy to rob.
Issues of participation and intent
Killing in the context of London gang culture. Issues of the use of covertly recorded conversations in custody. Extensive analysis of cell site material.
Appeals against conviction and sentence successfully resisted

R v McNamara Garland Liddy and Bennett 2008
On appeal 2009
The killing by a gang of youths of an innocent man in the course of a robbery.
The deceased died later from a pulmonary embolism. Issues of joint enterprise and causation as the death was a result of DVT caused by the original attack.
The issue on appeal concerned the adequacy of the directions on joint enterprise and intention. The appeal was successfully resisted.

R v Beckett 2008
Health and Safety Executive Prosecution / Gross Negligence Manslaughter. The successful defence of a company director charged with manslaughter.The defendant ran a small business and delegated supervision of a dangerous process to the deceased. The deceased was negligent in relation to the process. Issues of the extent to which delegation bore on the assessment of gross negligence and the minimum level of culpability set in such circumstances.

Issues of duress in relation to conspiracy to pervert the course of justice allied to the `honour killing’ of Banaz Mahmod.

R v Levey 2006
Baby smothering murder / manslaughter. Abuse of process.
Contrary decisions of the Family division and the Crown Court.
The Family division had conducted a causation hearing prior to the Criminal trial. Issues of medical expertise in particular relation to non-accidental injuries to a 3 month old child.

R v Dowler 2005
Causation in murder.
Issues of causation and the relevance of psychiatric evidence in the context of self-defence. The defendant attacked a youth with an axe. Treatment required the removal of a large part of his skull. A minor accident months later injured the area now unprotected causing death.

R v Yaqoob 2004 CCA 2005
Manslaughter by gross negligence. The owner of a taxi firm convicted of manslaughter resulting from the fitting of a part worn tyre that blew out.

An incident of drunken violence causing a subarachnoid haemorrhage leading to death.

DRUGS / CONFISCATION

R v Siddique [Afraz]
Ten handed large scale drug supply conspiracy. Involved video and audio probe evidence in conjunction with extensive observation material. £3.2m confiscation order. The appeal against the confiscation order is reported. REPORTED at :- [2005] EWCA Crim 1812 R v Siddique (Afraz) (2005) in relation to methods of assessment.

SEXUAL OFFENCES

R v Thomas 2008
The defendant accused of a series of rapes in 2005 and then in 2006. Tried in 2007 in relation to the second set and attempting to pervert the course of justice. Convicted but a retrial ordered by the CCA.
An abuse of process argument succeeded in preventing the trial of eight rapes said to have occurred in 2005. The defendant was acquitted on the retrial of the remaining 2006 allegations.

Conjunction of Pollen and DNA analysis.
Rapist caught by pollen analysis and DNA mass screening.

R v Justin McAuliffe
The curious case of a letter bomb campaign waged by a man with long standing grudges against a variety of individuals. The defendant constructed and sent three types of device graduated as to the harm these would cause in line with the perceived offence the recipient had caused him.
